Chapter 13,  Chapter 7 or Chapter 20?  

A Chapter 7 is primarily used to wipe out unsecured debts or redeem personal property.  Both Chapter 7 and Chapter 13 will stop garnishments and Creditor harassment. 

 A Chapter 13 is like a bill consolidation loan.  You normally file Chapter 13 because

  1. You need to stop a foreclosure
  2. You want to eliminate a second mortgage which has no equity
  3. Your income can afford some repayment of your debt 
  4. or you have filed a Chapter 7 within the prior 8 years.

The 2005 bankruptcy law was designed to eliminate repeat filings however people can file a Chapter 7 and eliminate unsecured debt and then file a Chapter 13 to stop a foreclosure.   This is often called a Chapter 20.  A second discharge may not be  needed.
